Terms of Service

These Terms of Service (the "Terms") govern your access to and use of BabylonJS Market, operated by Babylon.js Market LLC ("we", "us", or "our") — including our website, the marketplace, the component library, courses, developer tools, and the command-line interface (together, the "Service").

By creating an account, making a purchase, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who can use the Service

You must be at least 16 years old, or the age of digital consent in your country, to use the Service. If you use the Service on behalf of a company or organization, you represent that you have authority to bind them to these Terms.

2. Your account

You are responsible for your account, for keeping your login credentials secure, and for all activity that happens under it. Tell us promptly if you believe your account has been compromised. We may suspend or terminate accounts that violate these Terms.

3. Purchases, credits, and payments

Some parts of the Service are free and some are paid. Paid components, courses, and plans are sold either directly or through our credit system ("cheddar"). Payments are processed by our payment provider, Stripe; we do not store your full card details.

Prices are shown at the point of purchase and may change over time. Credits and purchases are generally non-refundable except where required by law or where we state otherwise in a specific offer. Taxes may apply depending on your location.

4. License to content you download

When you obtain a component, course, asset, or other content through the Service, we grant you a non-exclusive, worldwide license to use it in your own games, applications, and projects, subject to these Terms and any component-specific terms.

  • You may use, modify, and ship downloaded components and assets as part of your own projects.
  • You may not resell, sublicense, or redistribute the raw library files, courses, or assets as a competing product or on their own.
  • You may not remove proprietary notices or misrepresent authorship of the underlying content.

5. Creator submissions and programs

If you submit a component, course, or other material to the marketplace — including through the Creator, Fellowship, Education, or Affiliate programs — you keep ownership of your work. You grant us a non-exclusive, worldwide license to host, display, distribute, and promote it through the Service, and to let other members download and use it under the license above.

You represent that your submission is your own original work, does not infringe anyone else's rights, and complies with any program rules. Program rewards (credits, revenue share, grants, discounts, or promotion) are described on the relevant program page and may be updated from time to time.

6. Acceptable use

You agree not to:

  • Break the law or infringe the rights of others while using the Service.
  • Reverse engineer, scrape, overload, or interfere with the Service or its security.
  • Upload malware, or content that is infringing, deceptive, or unlawful.
  • Share paid content or your account access in ways that circumvent our licensing or payment systems.

7. Our intellectual property

The Service itself — including the platform, branding, site design, and the software we author — is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any right to our trademarks or branding except as needed to use the Service as intended.

8. Third-party services

The Service relies on and links to third-party services (for example, payment processing, email delivery, hosting, and open-source libraries such as Babylon.js). Your use of those services may be subject to their own terms, and we are not responsible for third-party content or services.

9. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim, or fifty US dollars.

11. Indemnification

You agree to indemnify and hold us harmless from claims and expenses arising out of your misuse of the Service, your content or submissions, or your violation of these Terms or the rights of others.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. Sections that by their nature should survive termination (such as licenses you have granted, disclaimers, and limitations of liability) will survive.

13. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you. Continuing to use the Service after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the United States and the state in which Babylon.js Market LLC is organized, without regard to conflict-of-laws rules. Disputes will be resolved in the courts located there, unless applicable law requires otherwise.
